Why and how to do a legal audit?

Only packages licensed under a free license can successfully pass through review process, i.e. to be included into Fedora. If the licensing is clear, one needs to move the package including headline and title from any of sections to either Fedora approved or Fedora disapproved sections. Please state clearly which license is appropriate to a package if moved to Fedora approved, e.g. adobemapping - BSD.

Thanks! --Jnovy 14:32, 14 October 2010 (UTC)

ankursinha: November 24, 2010. I found Mario Wolczko's homepage at Oracle. I've mailed him requesting clarification. Hoping it's the same one. :)

ankursinha: November 25, 2010. Received reply from Mario.

Mario:
Well, that takes me back. There are - what - 5 lines of code in there?
Anyhow, the file was placed in the public domain when I was in the UK.
The same goes for my other contribution in that collection, boxedminipage.sty.

He's asked us to use his personal email (mario AT wolczko DOT com) for further correspondance since it's not related to his Oracle work.

The program code (i.e. anything not under the /doc subtree) is
 distributed under the
 Creative Commons GNU GPL
For practical purposes distributers may also choose the L TEX project
 licence, which is
considered to be a bit more TEX friendly. (BSD alike licences, the Ruby
 Licence and the
Apache are all licences that apply well for ConTEXt.)

Hi Ben,

I’m the right person for the packages you mentioned.

To avoid the problem with the „Public Domain“ license you wrote I’ll
release all my files under GPL, updated version of them will be released
in the next time.

Until this happens I give you my permission to include all packages in
the Fedora distribution.

Wolfgang

Stijn Hoop Can I help determine whether these files were published earlier by finding copies on the web or does that not matter in the slightest? I found a bibtex.web that says it was distributed before 1989 at http://ftp.math.utah.edu/pub/tex/bibtex/bibtex.web , but that one appears to have a much stricter copyright notice:
% This program is copyright (C) 1985 by Oren Patashnik; all rights reserved.
% Copying of this file is authorized only if (1) you are Oren Patashnik, or if
% (2) you make absolutely no changes to your copy. (The WEB system provides
% for alterations via an auxiliary file; the master file should stay intact.)

Additionally, http://ftp.math.utah.edu/pub/tex/bibtex/bibtex.ins suggests a distribution of the files mentioned in the first copyright above alongside the bibtex.web file. All files (btxbst.doc, plain.bst, unsrt.bst are available in that same place, and do contain the first notice, along with a published date of 1988.

hannes I recently found this rather new mail: https://lists.dante.de/pipermail/ctan-ann/2010-December/004975.html Perhaps this solves all issues, or?
The documentation under [2] and bibtex.web state the following:
 % This program is copyright (C) 1985, 1988, 2010 by Oren Patashnik;
 % all rights are reserved.
 %
% This program, BibTeX, is available under the same terms as

[[User:spot|spot] Do those licenses account for all of the sources?

Public Domain

In many parts of the world, it is not possible for a copyright holder to abandon their copyright, and put a work into the Public Domain. Thus, it is important to determine where the code was written (and in some cases, who wrote it).

Code written by the United States Government is in the Public Domain (unless it was written by a contractor, or certain other corner cases). Individuals in the United States, Canada, and the UK can place works in the public domain with a clear Public Domain declaration stating that they abandon their copyright on a work.

Individuals in most Europe can almost NEVER fully abandon their copyright, thus any public domain declarations from those individuals are invalid, and we are left with no license on that work. Specifically, this is known to be true for France, Germany, and Poland.

Resolving Public Domain Confusion

The best case scenario is to have the Copyright holder relicense their work, under CC-0 or LPPL. If they're unwilling to do that, we need to have them confirm their nationality and the geographical location where the work was created. I have written an email template that you can use to contact individuals.

Here is an email template you can use. Please CC legal@fedoraproject.org on any emails that you send.

$NAME,

Hopefully I've found the correct $NAME, if not, I apologize in advance.

I'm looking for the $NAME who is the author of programs involving or
related to TeXLive.

Specifically:

 - $PROGRAM1
 - $PROGRAM2
 - $PROGRAM3

These programs are marked as being in the Public Domain, which is a
tricky legal concept in many parts of the world. We are in the process of
auditing all of the code in TeXLive 2010 for Fedora (a popular Linux
distribution) to ensure that we have legal permission to use everything
within it, and that everything is under a Free Software License.

Since the ability of a copyright holder to abandon their copyright on a
work and place it into the Public Domain is only legally possible in
certain jurisdictions, there are a few things you can do to help us
out here.

1) If you just want anyone, anywhere, to have the ability to do whatever
they would like with these software works, then please consider giving
permission for them to be used under the Creative Commons Zero license.
This license is structured to act as a practical Public Domain
declaration wherever that is permitted by law, and an extremely
permissive license everywhere else.

An overview of the CC-0 license is here:
http://creativecommons.org/publicdomain/zero/1.0/

The actual CC-0 legal text is here:
http://creativecommons.org/publicdomain/zero/1.0/legalcode

If you choose to exercise this option, please reply to this email with
the following:

* A statement affirming that you are the author and copyright holder of
the aforementioned software works.
* A statement that you give permission for these works to be distributed
under the terms of the Creative Commons 0 license, as described here:
http://creativecommons.org/publicdomain/zero/1.0/

We will archive that email in the public audit history (with your email
address obscured, if you wish).

2) If you do not wish to relicense these works under CC-0, consider
licensing them under the LaTeX Project Public License. This is a Free
Software license, and much of the code in TeXLive 2010 uses it.

Details on the current version of the LPPL are available here:
http://www.latex-project.org/lppl/

If you choose to exercise this option, please reply to this email with
the following:

* A statement affirming that you are the author and copyright holder of
the aforementioned software works.
* As desribed on the LPPL side, please provide an explicit copyright
notice including your name and the year that each work was authored
and/or last substantially modified. Include also a statement that the
distribution and/or modification of that component is constrained by the
conditions in this license. A dummy example is copied below:

  %% pig.dtx
  %% Copyright 2005 M. Y. Name
  %
% This work may be distributed and/or modified under the
% conditions of the LaTeX Project Public License, either version 1.3
% of this license or (at your option) any later version.
% The latest version of this license is in
  % http://www.latex-project.org/lppl.txt
% and version 1.3 or later is part of all distributions of LaTeX
  % version 2005/12/01 or later.

3) If neither of the two previous options is acceptable to you, and you
really just want to put the work into the Public Domain, we need you to
provide us with the following information:

* A statement affirming that you are the author and copyright holder of
the aforementioned software works.
* A statement which indicates your citizenship and geographical location
(country is sufficient) where these works were created.
* A statement declaring that you are placing these works (explicitly by
name) into the Public Domain, and are abandoning your copyright on them.

For example:

My name is John Doe, and I am the author and copyright holder of
pig.dtx. I am a United States citizen, and this code was written in the
United States. I hereby place the pig.dtx software into the public
domain. You are free to modify the package, distribute modified
versions, etc.

*****

Please note: Individuals in most of Europe (with the notable exception of
the UK) can almost NEVER fully abandon their copyright, thus any public
domain declarations from those individuals are invalid, and we are left
with no license on that work. This means that we will have no permission
to use, modify, or distribute it.

Specifically, this is known to be true for France, Germany, and Poland.
If you are a citizen of one of these countries (or in Europe), or were
located in one of these countries when you created this work, please
consider using one of the previously described license options.

Thanks in advance! If you have any questions, please do not hesitate to ask.

I am indeed the Alexander Holt who tweaked that style file back in 1994,

For my part, if I still have any say in the matter, I am happy for

Thank you very much for taking the time to do this.

  c) Copying conditions

The fc fonts are copyrighted but free according to the conditions of the GNU
licence, version 2. You should receive a copy of the file licence.gnu
containing this licence. If not, complain to the person from which you
received these fonts. Read the licence carefully.

The license.gnu file contains the GNU General Public License version 2, so it is free.

However, at least some files contain code from the Computer Modern fonts, with GPL-incompatible license requiring renaming source and TFM files if they are modified.

The fcpunct.mf file states:

% Heavily borrowed from dxpunct.mf and dxbraces by Norbert Schwarz, Bochum.
% Heavily borrowed (directly and indirectly) from the cm fonts by DEK.
% Some characters borrowed from R. Waldi's wasy font.

I haven't seen dxpunct.mf or dxbraces.mf, and the non-public domain wasy characters were not copied here. There might be other derivative code in other files.

xmlplay

The plays of Shakespeare have been marked up by Jon Bosak. This xmltex
package attempts to typeset them. The plays themselves can be got from
   http://www.oasis-open.org/cover/bosakShakespeare200.html
You will also need the `play' latex class, from CTAN.
This is an experimental package. Feel free to improve it as you see fit.
There are a number of shortcomings with this package (but I'm not going to
tell you what they are and spoil the fun!). Let me know how you get on.
